Temporary Rule Adoptions

Overnight Respite Rules

The Department of Health and Human Services was directed to pilot an overnight respite program in facilities that offer adult day care by Senate Bill 512 in Session Law 2011-104. These temporary rules are being proposed in response to this act by the General Assembly with the establishment of a new Subchapter entitled "Overnight Respite in Certified Adult Day Care Programs."

Proposed Rule Adoption

EMS Rule

The purpose for the proposed rule is to require the driver of an ambulance to hold a Medical Responder level or higher credential so that this driver will then be capable of not only performing the duties associated with vehicle operations but of having medical training to augment the attendant in the patient compartment of the vehicle.

Proposed Rule Amendments

Nursing Home Rules

In response to Executive Order 70, the purpose for the proposed rule amendments is to simplify and clarify current rule language, update reference names and addresses in rules, update rule authority in history notes, and add web site addresses to rules. In addition, the purpose of the repeal of one rule is that compliance is achieved through Public Records Law (N.C.G.S. Chapter 132), rendering this rule redundant.

SMFP Rules

These rules are obsolete. Repeal of these rules is necessary because G.S. 150B excludes the State Medical Facilities Plan from the definition of a rule.

G.S. 150B requires some rules and notices to be published in the North Carolina Register.
