NCDHHS Releases Statement on Stay Order Regarding Samantha R. et al. vs. NCDHHS and the State of North Carolina Court Case

NCDHHS is committed to empowering all individuals with intellectual and developmental disabilities with the resources they need to live healthy, independent lives in communities of their choosing. That commitment is why we are appealing part of the court order in Samantha R. et al. vs. NCDHHS and the State of North Carolina, which would have put individuals at risk for harm. Today the court issued a stay in the order, temporarily stopping the order while the appeal moves forward.

NCDHHS is committed to empowering all individuals with intellectual and developmental disabilities with the resources they need to live healthy, independent lives in communities of their choosing. That commitment is why we are appealing part of the court order in Samantha R. et al. vs. NCDHHS and the State of North Carolina, which would have put individuals at risk for harm. Today the court issued a stay in the order, temporarily stopping the order while the appeal moves forward.

NCDHHS will continue implementing our approved Olmstead Plan and leveraging it, to transform our state’s system of care. That work is informed by input from individuals with disabilities, family members, providers and multiple community stakeholders. We will continue to work in good faith with all parties and listen to feedback from a broad set of stakeholders to strengthen North Carolina’s ability to provide choice to individuals with I/DD.
